Know Your Rights: Texas Landowners and Pipeline Eminent Domain
Recently many of our local Maypearl residents have been approached by gas pipeline companies to add new gas pipelines across their property. The biggest fear is these pipelines will feed the data center being proposed in our community. It’s important to understand your rights when it comes to pipelines and especially the use of eminent domain.
When a pipeline company approaches a Texas landowner about an easement, it's important to understand that you do have rights. While some pipeline companies may have eminent domain authority, they cannot simply take your property without following strict legal requirements.
Before filing a condemnation lawsuit, the company must provide a written offer, a copy of the Texas Landowner's Bill of Rights, and an appraisal supporting its offer. You are not required to accept the first offer. In fact, many landowners negotiate for higher compensation and stronger protections for their property.
You also have the right to challenge whether the pipeline company actually has eminent domain authority and whether the project serves a legitimate public use. If the parties cannot reach an agreement, the case proceeds through the Texas eminent domain process, where landowners can present evidence, obtain their own appraisal, and seek a fair determination of compensation.
Just as important, the terms of a pipeline easement are often negotiable. Issues such as easement width, access roads, restoration, fencing, drainage, and future use of the property can all have lasting impacts.
